Opportunity Overview

The National Credit Regulator (NCR) was established under the National Credit Act 34 of 2005 to oversee and regulate the South African credit industry. Its mandate includes education, research, policy development, registration of industry participants, investigation of complaints, and enforcement of the Act.

A key focus of the NCR is to promote an accessible credit market, particularly for historically disadvantaged individuals, low-income persons, and communities in remote or isolated areas. The organisation is seeking a Senior Legal Advisor - Executive to contribute to these vital functions within its legal team.

Minimum Requirements

To be considered for this position, applicants must meet the following criteria:

  • Hold a relevant legal qualification.
  • Be an admitted attorney or advocate who has completed pupillage.
  • Possess a minimum of 8 years post-admission experience.
  • A minimum of 5 years of this experience must have been in a management or supervisory role within a legal, regulatory, or similar environment.

Key Responsibilities

The successful candidate will be responsible for a range of duties, including:

  • Overseeing the functions of the Executive department.
  • Overseeing the presentation of cases to the National Consumer Tribunal and the Courts, and representing the NCR in Tribunal proceedings.
  • Overseeing the overall enforcement of the National Credit Act.
  • Managing departmental aspects such as budget, human resources, and asset management.
  • Developing, reviewing, monitoring, and maintaining relevant departmental policies and procedures.
  • Providing legal advice to EXCO and various departments.
  • Attending to and providing legal advice on legal action taken by or against the NCR.
  • Participating in various committees.
  • Collaborating with relevant enforcement agencies and regulators in the litigation of cases pertinent to the NCR's mandate.
  • Preparing and moderating media statements to be released on behalf of the NCR.
